5. Refund Policy
- The Machine: 90-day support promise. If you are not satisfied, contact us within 90 days for personalized support to help you succeed.
- NuCalm products: Subject to XosialX's 30-day money-back guarantee (administered by XosialX, not BrainwaveMastery.com)
6. Affiliate Program
- Commissions are earned through the XosialX compensation plan
- Commission rates and structures are determined by XosialX and may change
- Affiliates must comply with all marketing guidelines provided in the Portal
- Affiliates may NOT make false or misleading claims about products or income
- Affiliates may NOT use spam, unsolicited messages, or deceptive marketing practices
- We reserve the right to terminate affiliate accounts that violate these guidelines
7. Prohibited Conduct
You agree not to:
- Make false, misleading, or unsubstantiated claims about NuCalm or The Machine
- Represent NuCalm as an "FDA-approved medical device" (it is a General Wellness Product)
- Guarantee specific income amounts to potential affiliates
- Use deceptive, misleading, or unethical marketing practices
- Violate any applicable laws or regulations including FTC guidelines
- Attempt to access other users' accounts or data
- Use our Services for any illegal purpose
8. Intellectual Property
- All content on our websites is owned by or licensed to BrainwaveMastery.com
- Share Kit materials are licensed for affiliate use only and may not be modified without permission
- NuCalm® is a registered trademark of Solace Lifesciences, Inc.
- You may not reproduce, distribute, or create derivative works without permission

NuCalm products are manufactured and distributed by Solace Lifesciences, Inc. through XosialX. BrainwaveMastery.com is an independent affiliate and is not affiliated with, endorsed by, or sponsored by NuCalm LLC or Solace Lifesciences, Inc.

To the maximum extent permitted by law, BrainwaveMastery.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.

14. Traffic Co-Op
A 15% platform management fee applies to all Traffic Co-Op subscriptions, covering AI campaign optimization, fraud detection, rotator technology, and performance reporting. This fee is included in the subscription price and is non-refundable. The Traffic Co-Op operates on a shared-cost model; individual results may vary based on market conditions, campaign performance, and member participation.
